1 - Who are we?

E-canopy, identified by the domain name www.enviedart.com, is a public limited company with a capital of 43,600 Euros, registered with the Paris Trade and Companies Register, under the number RCS Paris B 430 323 477 and which has for object, in France and abroad, the sale of art objects in all forms and the reproduction of works for their exhibition, in particular on digital support. Envie d'art proposes a selection of the best contemporary art on the walls of its Parisian and London galleries and its online gallery.

2 - What is the purpose of these general conditions of sale?

These General Conditions of Sale define the conditions in which we sell the works of art presented on our website as well as your rights and obligations in this regard.
The fact for you to fill a purchase order on our website and to confirm this order is worth full acceptance of these general conditions, which, added to the order form, constitute your contract.


3 - How to order an artwork on our website?

To order an artwork on our website, you must first become a member of Enviedart. This membership is free and will allow you to benefit from privileged services. For this purpose, you must complete, following the instructions provided online, the form available on our website.

You can then order an artwork by completing the order form also available to you. This purchase order contains the identification, the characteristics and the total price of the artwork, as well as the method of payment that you must choose. You must then confirm your order by "clicking" on the icon provided for this purpose.

This confirmation entails the conclusion of the contract of sale of the artwork that you have ordered, provided that we confirm your order (hereinafter the "Contract").

We will confirm receipt of your order by sending an email after checking the availability of the artwork and validation of payment. Validation of payment occurs after the approval of the authorization centre in case of payment by credit card and after cashing your check in case of payment by check.



4 - How to pay for your purchases?

You can pay by credit card (cards accepted: Eurocard, Mastercard, Visa, Carte Bleue). In this case, you interact directly with your bank's secure payment server, which guarantees the confidentiality of the information provided.

The secure payment server verifies the validity of the credit card used before granting the payment authorization and automatically confirms the result.

You can also pay by check from a French bank, the check may be in French francs or euros, to the order of Enviedart and sent to the following address:

Do not forget to include your email address on the back of the check and the number of your order.
The price indicated on your purchase order corresponds to the total amount of which you are indebted. It includes the price of the work, the cost of packing and transport.

Prices are indicated in French francs and euros. For France and the member countries of the European Union, the prices include all taxes (TTC).


5 - When will you be delivered?

Delivery will be made, during business hours, to the delivery address that you have indicated when you join Enviedart, within an average of 15 days from the date we confirmed your order.
The transfer of risks concerning artworks purchased by you takes place as soon as they are handed over by the artist to the carrier.
It is your responsibility, in case of default or damage, to make precise and detailed reservations to the carrier, during delivery and at the latest within three days (excluding holidays) by mail or email to Enviedart.com.


6 - You are satisfied or refunded

In accordance with Article L.121-16 of the Consumer Code, you have a period of 7 days from the delivery of your order to return the work ordered to exchange or be refunded , without penalty (with the exception of the costs of return, which are your responsibility). If this period expires on a Saturday, Sunday or a non-working day, it is extended until the next business day. In order to exercise this right, you must send us an e-mail to the following address: contacts@enviedart.com indicating (optional) the reason for the return. Enviedart will confirm the return address of the works.


7 - Your rights on the artwork

The artist, for having taken the initiative of its creation, remains owner of the copyright on its creation, within the meaning of the French law. The rights of representation and reproduction of the artworks presented on the site Enviedart.com belong to their authors and Enviedart. Their joint authorization is necessary for any exploitation of these rights.

Your rights on the artwork purchased are therefore limited to a right of private use, excluding any right of representation and reproduction.

8 - How is the work that you buy authenticated?

All the works presented on our website are original artworks that come directly from the artist's studio. An invoice, receipt or bill containing the specifications provided at the time of the placing of the order and concerning the nature, the composition, the origin and the oldness of the work, will be provided on request from your part.


9 - What do we do with the information about you?

The information you give us, in the registration form and your purchase order, or by any other means, may be the subject of computerized processing to allow the processing of your file, the security of payments, shipping of the commissioned artwork and the setting up of commercial actions. This information may, therefore and exclusively for the aforementioned purposes, be communicated, in France and abroad, to public bodies or private companies. By confirming your order, you authorize us to distribute them under these conditions.

In accordance with the law n ° 78-17 of January 6, 1978 (data processing and liberties), you can access this information, ask for their modification or rectification or require to no longer appear in our database. 10 - How can force majeure affect your contract?

Enviedart cannot be responsible or considered to have committed a fault in the treatment of your file prior to the formation of the Contract or in the execution thereof, any delay or non-performance, if such delay or such non-performance results a case of force majeure (for example a storm) in accordance with Article 1148 of the Civil Code, as interpreted by French case law.


11 - What are your guarantees?

Enviedart undertakes to respect all legal warranties that you may have.
The works presented on our website being in conformity with the prescriptions of the French law, we will not be able to be held responsible for the violation of the legislation specific to the country of delivery of the work. Therefore, we invite you to read the law in force in the country of delivery.


12 - What is the applicable law?

The Contract is governed by French law. Any difference arising from the formation of the interpretation of the execution of the Contract will be subject to the exclusive jurisdiction of the Courts of Paris.
